Tourists fight extradition over Cyprus death

Two Essex men facing three years in a Cypriot jail for their involvement in a teenager's death could find out if they will be extradited back to the country.
Luke Atkinson, 23, and Michael Binnington, 22, both of Witham, will appear at City of Westminster Magistrates' Court to fight the extradition.

They were in a car driven by Atkinson's uncle, Julian Harrington, in Protaras, Cyprus in 2006 when he hi
t a moped.

Christof Papiris, 17, was knocked off the bike and died.

Harrington, 40, also from Witham, is serving a 15-year jail sentence after admitting manslaughter and causing grievous bodily harm.

Atkinson and Binnington were initially acquitted, but in April this year in their absence were found guilty of conspiracy to cause manslaughter, and sentenced to three years in prison.

Labour Euro MP Richard Howitt, who represents Essex, said: "Our case is based upon the fact that European standards of justice were not met. The boys were tried in Cyprus without their knowledge.

"Legally, extradition can only take place where a retrial is possible. As no properly constituted trial took place, there can be no retrial, and there must be no extradition.

"If justice is delivered it will be the end of a two year ordeal which has blighted not only Michael and Luke but their entire families and the boys will finally be free to get on with a normal life."

It is not known whether the hearing will conclude, and if so whether a ruling will be given immediately or at a future date.
