Wisbech driver thought he would OK to drive

A Wisbech driver who only passed his test in July has been banned for excess alcohol.

Rodrigo Silva, 19, told a court he had not had a drink for a couple of hours beforehand and thought he would be under the limit by then.

He was pulled over by police in Wisbech Road, King’s Lynn, at 4.20am on October 31.

Monali Raleraskar, prosecuting at Lynn Magistrates’ Court on Thursday (2), said: “Whilst speaking to the defendant, officers could smell alcohol and formed the impression he had been consuming alcohol.

“He said 'I’ve been out for the night with friends and had a few drinks'.”

Silva, of Kenlan Road, was arrested after failing a roadside breath test.

In custody he blew 55 micrograms of alcohol in 100 millilitres of breath, the legal limit being 35.

He pleaded guilty to drink-driving.

In mitigation, he told the court: “I didn’t think I’d had that much to drink but obviously the breathalyser doesn’t lie.

“I still waited – I didn’t have a drink for a couple of hours before.”

Silva was banned for 14 months, which can be cut with completion of a drink-driver rehabilitation course.

He was also fined £150 and ordered to pay £34 victim surcharge.
